Managing Disabilities and the Duty to Accommodate

Accommodation in the workplace

Overview:

Employers have a legal duty to take reasonable steps to adjust rules, policies or practices to accommodate an employee’s individual needs. Accommodation in the workplace consists of removing barriers so that all employees can participate fully. This training program provides Managers, Supervisors, HR professionals, and Union representatives with the tools to effectively manage requests for accommodation under the BC Human Rights Code.

Instructional Objectives:

The training program covers the following topics:

  • An Employer’s Responsibility to Accommodate
  • Disclosing a Disability
  • Prohibited Grounds of Discrimination
  • Informal vs. Formal Accommodations
  • Undue Hardship
  • Reasonable & Unreasonable Accommodation

Measuring Learning Outcomes:

By the end of the training, participants will understand:

  • How to define Duty to Accommodate as it pertains to the prohibited grounds under the Canadian Human Rights Act, the Employment Equity Act and other relevant legislation;
  • How an employer/union/management can provide support to employees who disclose a disability;
  • The responsibilities of both the employer and employee when issuing an accommodation;
  • How to apply learning to scenarios in which duty to accommodate is required;
  • How to facilitate an employee’s return to work (where possible)

Program Delivery & Assessment Methods:

Pivot HR Services instructors continuously assess participants comprehension and ability to apply learning concepts through a combination of facilitation, interactive discussion, group work, case studies, and relevant real-world examples. Pre & Post learning self-evaluations are delivered to provide participants with a measure of their knowledge and skills gained from training. Following training, participants are encouraged to connect with instructors via phone and e-mail should they need assistance and have questions to follow.
